NOTICE OF MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain Mortgage executed by Jack A. Wagstaff and Shuree D. Munden Wagstaff, husband and wife, to New South Federal Savings Bank, dated the 19th day of August, 2009, which Mortgage was recorded in the Office of the Judge of Probate of Cullman County, Alabama, in Mortgage Book 1606, at Page 850; said Mortgage having been transferred and assigned by New South Federal Savings Bank to Mortgage Electronic Registration Systems, Inc. (“MERS”), (solely as nominee for Lender, New South Federal Savings Bank, and Lender’s successors and assigns) by virtue of that certain Assignment of Mortgage dated August 28, 2009 and recorded in said Probate Office in Miscellaneous Book 261, at Page 141; said Mortgage having been further transferred and assigned by Mortgage Electronic Registration Systems, Inc. (“MERS”), (solely as nominee for Lender, New South Federal Savings Bank, and Lender’s successors and assigns) to Alabama Housing Finance Authority by virtue of that certain Assignment of Mortgage dated June 4, 2015 and recorded in said Probate Office in Miscellaneous Book 308, at Page 546. The undersigned, Alabama Housing Finance Authority, as Assignee of said Mortgage will, under and by virtue of the power of sale contained in said Mortgage, sell at auction to the highest bidder for cash before the main entrance of the Cullman County Courthouse in the City of Cullman, Alabama, during the legal hours of sale on August 25, 2015, the real property described in said Mortgage, which said description is hereby referred to and made a part hereof, said property being situated in Cullman County, Alabama, to-wit: Commence at the Southeast corner of the Northwest Quarter of the Northeast Quarter of Section 36, Township 9 South, Range 4 West; thence North 00 degrees 41 minutes 17 seconds West 133.0 feet to the point of beginning; thence continue North 00 degrees 41 minutes 17 seconds West 127.7 feet to a point on the South right of way of County Road Number 1184; thence South 84 degrees 48 minutes 43 seconds West 171.23 feet to a point; thence North 82 degrees 27 minutes 17 seconds West 207.45 feet to a point along said right of way; thence South 12 degrees 22 minutes 17 seconds East 148.46 feet to a point along the East right of way of a gravel road; thence North 89 degrees 04 minutes 42 seconds East 345.95 feet to the point of beginning. Said land lying in the Northwest Quarter of the Northeast Quarter of Section 36, Township 9 South, Range 4 West, Cullman County, Alabama. Less and except that portion of property conveyed by Judgment for Easement to Southern Natural Gas.
