FA-15-23 (Published in the Friday edition of The Duncan Banner, September 11, 2015-1 time) IN THE DISTRICT COURT OF STEPHENS COUNTY STATE OF OKLAHOMA In the Matter of the Adoption of REMMINGTON JOE HALL, a Minor Child Case No.: FA-15-23 AMENDED NOTICE BY PUBLICATION OF PETITION FOR ADOPTION WITHOUT CONSENT AND TERMINATION OF PARENTAL RIGHTS TO: Joshua James Wiggington and any other individual claiming rights of custody, paternity or visitation to the minor child, Remmington Joe Hall You are hereby notified that a Petition has been filed in District Court of Stephens County, State of Oklahoma, for the adoption of Remmington Joe Hall, a child of the male sex, born on December 16, 2014. Petitioners state that the child is eligible for adoption without the consent of the natural mother and father. The application alleges that the mother is JoMarie Hall and that the mother and father’s consent to this adoption is not required by law for the reason that the mother and father have abandoned the child. More specifically, the minor child is being placed for adoption within fourteen (14) months of his birth, and the father or putative father has failed to show that he has exercised parental rights or duties toward the minor, including but not limited to failure to contribute to the support of the minor to the extent of his financial ability, which may include consideration of his failure to contribute to the support of the mother of the child to the extent of his financial ability during her term of pregnancy. You are further notified that this Court will hear the evidence in support of and in opposition to the granting of said Application and said Petition on the 13th day of October, 2015, at the hour of 10:00 o'clock A.M., at the District Courthouse of Stephens County in Duncan, Oklahoma. If you have any cause to show why the above mentioned Application and Petition should not be granted by the Court, or why said child is not eligible for adoption without your consent, you should appear and present the same at the above stated time and place. Failure to appear at the hearing shall constitute a denial of interest in the child, which denial may result, without further notice of this proceeding or any subsequent proceeding, in the granting of the Application For Adoption Without Consent or Permanent Relinquishment and in the child's adoption. If you are indigent and cannot for that reason employ counsel, the Court shall appoint counsel. In all counties having county indigent defenders, the counties indigent defenders shall assume the duties of representation in such proceeding. Furthermore, the biological Indian parents, the child’s Indian custodian and the child’s tribe, the Cherokee Indian Nation, has the absolute right to intervene in this proceeding; if the Indian parent(s) or Indian custodian(s) are unable to afford counsel, and where a state court determines indigency, counsel will be appointed to represent the Indian parent or Indian custodian where authorized by state law; the Indian parents; Indian Custodian; and child’s tribe have the right to be granted, upon request, up to twenty (20) additional days to prepare for the proceedings and have the further right, to petition the court for transfer of the proceedings to the child’s tribal court pursuant to 25 U.S.C. 1911, absent objection by either parent, providing that such transfer shall be subject to declination by the tribal court of said tribe; that child custody proceedings are conducted on a confidential basis, all parties notified shall keep confidential the information contained in the notice concerning the particular proceeding, that the notices shall not be handled by anyone not needing the Information contained in the notices in order to exercise the tribe’s rights under the Act.
