STATE OF ALABAMA COUNTY OF LIMESTONE NOTICE OF MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by SHAWNA MICHELE SHUEY A/K/A SHAWNA MICHELLE SHUEY, unmarried, on the 10th day of April 2010, to VANDERBILT MORTGAGE AND FINANCE, INC., as recorded in RLPY Book 2014, Page 15682, in the office of the Probate Judge of Limestone County, Alabama; VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given, that acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Athens, Limestone County, Alabama, during the legal hours of sale on November 13, 2015, the following described real and personal property situated in Limestone County, Alabama, to-wit: Part of Lots No. 1 and 2, Lot No. 3 and 4 of the Porter Subdivision as recorded in the Probate Office of Limestone County, Alabama, in Plat Book “B”, Page 86, and being more particularly described as follows: Beginning at an existing railroad spike at the Southwest corner of Section 36, Township 1 South, Range 4 West; thence run North 01 degree 48 minutes 25 seconds West a distance of 1338.55 feet to an iron pin on the South boundary of the said Porter Subdivision; thence North 88 degrees 57 minutes 21 seconds East along the South boundary of the Porter Subdivision a distance of 345.82 feet to an iron pin at the Southwest corner of Lot No. 4 of the said Porter Subdivision, the Point of True Beginning of the herein described tract; thence from the Point of True Beginning run North 01 degree 02 minutes 39 seconds West along the West boundary of Lot No. 4 of the Porter Subdivision a distance of 219.56 feet to an iron pin on the South right of way margin of Porter Road at the Northwest corner of Lot No. 4 of the said Porter Subdivision; thence North 88 degrees 57 minutes 21 seconds East along the South right of way margin of the Porter Road (being 30 feet in width) and the North boundary of Lots 2, 3 and 4 of the said Porter Subdivision a distance of 126.78 feet to an iron pin on the Westerly right of way margin of Alabama Interstate 65; thence South 20 degrees 34 minutes 54 seconds East along the Westerly right of way margin of Alabama Interstate 65 a distance of 232.97 feet to an iron pin on the South boundary of the said Porter Subdivision; thence South 88 degrees 57 minutes 21 seconds West along the South boundary of the said Porter Subdivision a distance of 204.69 feet to the Point of True Beginning and containing 0.835 acres, more or less. INCLUDING a security interest in one (1) 2005 Clayton manufactured home, Serial No. CLA053811TN; together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. Said sale will be made subject to any existing Federal Tax Lien, if any, and/or Special Assessments, if any, which might adversely affect the title to the subject property. Said sale will be made for the purpose of paying the indebtedness secured by the above-described mortgage, and the proceeds thereof will be applied as provided by the terms of the said mortgage.
