Brian D. Burns, a Justice of the Supreme Court of the State of N.Y., dated August 25, 2015 and filed along with the supporting papers in the Delaware County Clerk's Office. This is an action to foreclose a mortgage. The premises is described as follows: All that tract or parcel of land, situate in the Town of Deposit, Delaware County, and the State of New York, being a cottage lot on the west side of Silver Lake in the Town of Deposit, Delaware County, New York. The boundaries of said lot are as follows: Beginning at a stake at low water mark on said Silver Lake, thence running 100 feet in a westerly direction between the lands of Lourine Fox and the lands of the party of the first part to the eastern boundary of a driveway, thence 40 feet in a southerly direction along the boundary of said driveway to a stake, thence 100 feet in an easterly direction through the lands of the party of the first part to a stake at low water mark on said Silver Lake, thence 40 (feet) in a northerly direction along the line of low water to the point or place of beginning. Recites: Party of the second part is to have the right in common with others to use said Silver Lake for recreational purposes including bathing, fishing, boating, skating and cutting ice for the use of the cottage to be erected on said lot, also the right in common with others to use the driveway leading to the main highway as a means of ingress and egress to and from said cottage lot, also to dip water from the spring belonging to the party of the first part for drinking and culinary purposes, also party of the second part is to have the right cross a lot owned by party of the first part as a short cut to the above described lake front lot from her own cottage until such time as a cottage is completed on the lake front lot. Also, all that tract or parcel of lands, situate in the Town of Deposit, County of Delaware and State of New York, being a cottage and cottage lot on the west side of Silver Lake in the Town of Deposit, Delaware County, New York. The boundaries of said lot are as follows: Beginning at a corner stake on the driveway, thence 75 feet in a southerly direction between the lands of the parties of the first part and those of Loraine Fox and also the Silver Lake water pumping corporation to a stake, thence 100 feet in a westerly direction through the lands of the parties of the first part to a stake, thence 75 feet in a northerly direction between lands of the parties of the first part and those of Herbert H. and Violet Fitch to a stake. Thence 100 feet in an easterly direction along the south side of the 15 foot driveway to the point or place of beginning. Recites: Party of the second part is to have the right in common with others to the use the 15 foot driveway leading to the public highway as a means of ingress and egress to and from said cottage; lot also the right in common with others to use the 10 foot right of way for said Silver Lake and to sue the dock at the lake and of said right of way. Also the right in common with others to use said Silver Lake for recreational purposes including boating, bathing, fishing, skating and cutting ice for the use of the cottage on said lot. Also the right in common with others to dip water for drinking and culinary purposes from the spring owned by the parties of the first part.
