NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS (NOIRROF) October 22, 2015 Town of Davenport Town Hall, 11790 State Highway 23, P.O. Box 88 Davenport Center, New York 13751 (607) 278-5600 On or about October 30, 2015, the Town of Davenport will submit a request to the Office of Community Renewal for the release of CDBG funds under Title 1 of the Housing and Community Development ct of 1974, as amended, to undertake a project known as Town of Davenport Housing Rehabilitation Program for the purpose of making home improvements to correct code violations, address health and safety issues, assure that the property passes Housing Quality Standards, and other improvements to extend the life of the home for income eligible owner/occupants of single family homes in the Town of Davenport. The estimated funding for this project includes the above referenced CDBG funds in the amount of $400,000 and an estimated $58,500 to be leveraged from the Weatherization Assistance Program for a project total of $458,500. The activities proposed are catergorically excluded under HUD Regulations at 24 CFR Part 58 from National Environmental Policy Act Requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Davenport Town Hall, 11790 State Highway 23, Davenport Center, New York each Tuesday to Thursday 9:00 am to Noon or at Delaware Opportunities Inc. 35430 State Highway 10, Hamden, New York and may be examined or copied weekday's 8 AM to 5. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Davenport Town Hall, P.O. Box 88, Davenport Center, New York 13751 or to Delaware Opportunities Inc. 35430 State Highway 10, Hamden, New York 13782. All comments received by October 29, 2015 will be considered by the Town of Davenport prior to submission of a request for release of funds. RELEASE OF FUNDS The Town of Davenport certifies to the Office of Community Renewal that Dennis J. Valente in his capacity as Town Supervisor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Office of Community Renewal's acceptance of the certification satisfies its responsibilities under NEPA and allows the Town of Davenport to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Office of Community Renewal will accept objections to its release of fund and the Town of Davenport's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the by the Certifying Officer of the Town of Davenport ; (b) the Town of Davenport has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c ) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Office of Community Renewal; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Chritian Leo, Vice-President, at Office of Community Renewal, Hampton Plaza, 38-40 State Street, 4th Floor, Albany, NY 12207.
