October 17, 2018 BOCC Minutes The Board of County Commissioners met in regular session in the office of the Board of County Commissioners of Oklahoma County in Room 204 at 9:00 a.m., October 17, 2018, pursuant to adjournment of October 10, 2018, with the following members present: Ray Vaughn, Chairman; Willa Johnson, Member; Steve Satterwhite, Chief Deputy on behalf of Brian Maughan, Vice-Chairman, Absent. Minutes of the meeting were taken by the Office of David B. Hooten, County Clerk and Secretary to the Board. Call to order by Ray Vaughn, Chairman, at 9:00 a.m. Notice of the meeting was posted Monday, October 15, 2018. Prayer and Pledge of Allegiance was led by Jay Rutledge, District No. 1. Johnson moved, Satterwhite seconded; motion carried unanimously to approve the minutes of the meeting of Wednesday, October 10, 2018, prepared by the County Clerk as authorized by statute 19 O.S. § 243, 244, and 445 subject to additions or corrections by the Board of County Commissioners. Johnson moved, Satterwhite seconded; motion carried unanimously to approve/receive the following items: Workers’ Compensation claim payments from Consolidated Benefits Resources in the amount of $8,284.58 for period ending 10-8-18, pending notification of encumbrance to Jackie Wilson, County Treasurer's Office. Tabulation of bids from the Central Purchasing Department with recommendation for selection of lowest and best bid: CW19064 On-line surplus auction services-Rebid Award No. 40-18 Govdeals Inc. Satterwhite moved, Johnson seconded; motion carried unanimously to approve an agreement between The City of Harrah and the Board of County Commissioners of Oklahoma County for reconstruction of Janene Drive going north 1374 feet from South East 44th Street. Work includes but is not limited to clearing and grubbing right of way, reconstructing roadway subgrade, placing recycled asphalt pavement, replacing cross culverts, reshaping ditch lines and placing sod. The City of Harrah will reimburse Oklahoma County at an estimated cost of $7,450.00. Satterwhite moved, Johnson seconded; motion carried unanimously to approve the Agreement for Services between Smith Roberts Baldischwiler, LLC and the Board of County Commissioners to provide Consultant Engineering Services for the Oklahoma County Project BR-2008, Three 3 Bridges on SE 44th Street east of Harrah Road. The total agreement cost shall not exceed $175,000.00. Requisition No 11902927 has been issued to Smith Roberts Baldischwiler, LLC in the amount of $175,000.00 from CBRI Fund 11116120, contingent upon encumbrance of funds. Vaughn moved, Johnson seconded; motion carried unanimously for approval of an agreement between the City of Edmond and the Board of County Commissioners of Oklahoma County for reconstruction of Danforth Rd between Douglas Blvd and Post Road. Work includes but is not limited to clearing and grubbing right of way, reconstructing roadway subgrade, replacing cross culverts, reshaping ditch lines and erosion control. Total amount of agreement not to exceed $145,000.00. City of Edmond will reimburse Oklahoma County for 100% of the project costs. Satterwhite moved, Johnson seconded; motion carried unanimously to approve the Construction Contract between L.G. Construction Co., Inc. and the Board of County Commissioners for Oklahoma County Project No. CTH-2017-2, Courthouse 9th Floor Repurpose, Mechanical HVAC System. The total amount of the contract shall not exceed the base bid of $664,985.00 and the alternate bid of $7,985.00 per unit price. Requisition No. 11900130 has been issued to L.G. Construction Co., Inc. for the amount of the base bid and Requisition No. 11902903 has been issued to L.G. Construction Co., Inc. for the amount of the alternate bid from Capital Improvement/TIF Revolving Fund 20103230, contingent upon encumbrance of funds. Johnson moved, Satterwhite seconded; motion carried unanimously for approval to participate in the State Environmental Abatement Program through the Construction and Properties Department CAP of the State of Oklahoma Office of Management and Enterprise Services OMES. These services are required to perform abatement services of the 6th Floor of the Oklahoma County Annex Building. The total project cost equals an amount not to exceed $868,960.13. Requisition No. 11902910 has been issued to Tec-An, Inc. in the amount of $839,575.00 for Contractor Services; and Requisition No. 11902911 has been issued to OMES in the amount of $29,385.13 for the CAP Administrative Fee from Capital Improvement Fund 20101200, contingent upon encumbrance of funds. Johnson moved, Satterwhite seconded; motion carried unanimously to approve the Renewal with OMES and the Board of County Commissioners from General Fund /Centralization MIS/IT 100/2700. This is for our primary internet connection and connectivity for the Court House, Annex, and OSU Extension. The total amount is not to exceed $4,704.00. Requisition 11902853 has been issued to OMES pending encumbrance of FY19 funds. Johnson moved, Satterwhite seconded; motion carried unanimously to approve the assignment with Waterfield Technologies to take over the current contract previously assigned to PDT Communications for the remainder of the 2018 – 2019 contract. This is for the maintenance and support of the Interaction Client telephone system and polycom phones. PO’s 21901010, 21900802, 21900801, 21900800, 21900430, 21900423, 21900299, 21900298, 21900297, 21900296, 21900295, 21900294, and 21900293 have been issued to PDT from the FY19 funds. Johnson moved, Satterwhite seconded; motion carried unanimously for the MIS Department to deliver an update to the Board of County Commissioners as to the status of the Oklahoma County phone system per suggestion by the Policy and Governance Committee. Satterwhite moved, Johnson seconded; motion carried unanimously to approve Resolution No. 150-18 releasing the Erosion Control Letter of Credit #1025249 for Addington Farms, Section I. All paving and drainage improvements have been completed to Oklahoma County Road Standards and erosion controls are in place as provided in Oklahoma Statutes, Title 19, §868.8. Johnson moved, Satterwhite seconded; motion carried unanimously to approve all claims, list available for inspection in the office of the County Clerk, Room 201. Johnson moved, Satterwhite seconded; motion carried unanimously to approve Resolution No. 151-18 approving Blanket Purchase Orders as submitted by each department, list available for inspection in the office of the County Clerk, Room 201. Board of County Commissioners of Oklahoma County, et al., Case No. CIV-17-1309D, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the case, or proceeding, in the public interest. To enter into executive session pursuant to 25 O.S. 307 B 4 to engage in confidential communications between the public body and its attorney concerning a pending investigation, claim or action against H&K Cattle Trucking, LLC and Z.W. Hayes arising out of damage caused by an automobile accident on or about September 5, 2018 at SH-74 and Coffee Creek Road, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest. To enter into executive session pursuant to 25 O.S. 307 B 4 to engage in confidential communications between the public body and its attorney concerning a pending investigation, claim or action by Craig and Wright v. City of Oklahoma City, et al, Case No. CJ-2017-4237, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest. To enter into executive session pursuant to 25 O.S. 307 B 4 to engage in confidential communications between the public body and its attorney concerning a pending investigation, claim or action in Hooks v. Bethany Police Dep’t et al, CIV-17-658-M, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest. To enter into executive session pursuant to 25 O.S. 307 B4 to engage in confidential communications between the public body and its attorney concerning a potential claim against the State of Oklahoma and the Office of Juvenile Affairs for the payment of the State’s statutory portion of costs associated with the operation of a juvenile detention facility, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest. Action regarding confidential communications between the public body and its attorney, Randall Wood, concerning the case by Elizabeth Ann Chrisman v. Board of County Commissioners of Oklahoma County, et al., Case No. CIV-17-1309D, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the case, or proceeding, in the public interest. Satterwhite moved, Blough seconded; motion carried unanimously to receive status report on Chrisman case. Action regarding confidential communications between the public body and its attorney concerning a pending investigation, claim or action against H&K Cattle Trucking, LLC and Z.W. Hayes arising out of damage caused by an automobile accident on or about September 5, 2018 at SH-74 and Coffee Creek Road, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest. Satterwhite moved, Blough seconded; motion carried unanimously to approve a settlement figure as recommended by counsel with regard to the negotiation to the claim in this particular action. That figure has been provided as requested. Action regarding confidential communications between the public body and its attorney concerning a pending investigation, claim or action by Craig and Wright v. City of Oklahoma City, et al, Case No. CJ-2017-4237, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest. Satterwhite moved, Blough seconded; motion carried unanimously to grant settlement authority as discussed in executive session. Action regarding confidential communications between the public body and its attorney concerning a pending investigation, claim or action in Hooks v. Bethany Police Dep’t et al, CIV-17-658-M, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest. Satterwhite moved, Blough seconded; motion carried unanimously to approve as to the expenditure of $819.20 to produce medical records in that case. Action regarding confidential communications between the public body and its attorney concerning a potential claim against the State of Oklahoma and the Office of Juvenile Affairs for the payment of the State’s statutory portion of costs associated with the operation of a juvenile detention facility, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest.
