Public Notice Published In THE CLAREMORE DAILY PROGRESS, Claremore, Rogers County, Oklahoma, NOVEMBER 18, 2018. RESOLUTION NO. 2018-03 THE INTERNATIONAL FIRE CODE A RESOLUTION of the Verdigris Fire Protection District adopting the 2015 edition of the International Fire Code, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises in the Verdigris Fire Protection District; providing for the issuance of permits and collection of fees therefor; repealing all other resolutions or parts of laws in conflict therewith. Therefore, pursuant to the authority of 19 OS § 901.1 - 901.29 the duly elected board of directors of the Verdigris Fire Protection District, A fire protection district created pursuant to the aforementioned statute, do ordain and establish the following to be the general regulations governing the matter set forth herein as pertains to Verdigris Fire Protection District, Rogers County, Oklahoma: Section 1. §1.1 Adoption of Fire Prevention Code That a certain document, at least one copy of which are on file in the office of the headquarters of Verdigris Fire Protection District, being marked and designated as the International Fire Code, 2015 edition, Including the following Appendices: (A) Appendix Chapters B: Fire-Flow Requirements (B) Appendix Chapters C: Fire Hydrant Locations and Distribution (C) Appendix Chapters D: Fire Apparatus Access Roads As published by the International Code Council, be and is hereby adopted as the Fire Code of the Verdigris Fire Protection District, in the State of Oklahoma regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the Verdigris Fire Protection District are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Section 2 of this ordinance. §1.2 Adoption of Additional Standards The current referenced national and state codes and standards adopted by the Office of State Fire Marshal in Title 265 Chapter 25 Section 265:25-1-3 of the Oklahoma Administrative Code and any updates to such codes, standards and regulations are incorporated by reference as a part of the Fire Prevention Code of the Verdigris Fire Protection District. In the event there are inconsistencies or duplication in the requirements of these provisions incorporated by reference, the provisions incorporated by reference shall prevail, except where the regulations of the International Fire Code are more stringent. §1.3 Fire Code Official The Fire Chief or Designee shall serve as the Fire Code Official designated in the adopted Fire Prevention Code for the Verdigris Fire Protection District. §1.4 Matters Not Specified The Fire Code Official shall have the ability to promulgate rules, regulations, policies, and procedures regarding open burning, open flames, open torches, and other such similar uses fire to insure the safety of the public when such rules, regulations, policies, and procedures are not specified by the adopted Fire Prevention Code of the Verdigris Fire Protection District. §1.5 Key Box System To insure compatibility with the present key box system and related devices, the manufacturer of such devices shall be the “KIDDIE SUPRASAFE”. A “SUPRASAFE” will be required on all commercial buildings that are not open 24/7 with a supervisor present with a fire alarm and fire suppression system and other occupancies as determined by the Fire Code Official. §1.6 Fire Marshal (A) A Fire Marshal may be appointed by the Fire Chief and work under the direction of the Fire Chief. (B) The Fire Marshal shall be deemed a peace officer, when so authorized by the Fire Chief, with full powers of a peace officer, including the right to execute legal process and make arrests. (C) In addition to any other duties assigned by the Fire Chief, the Fire Marshal's duties are: to make investigations of arson; suspected arson, or conspiracy to defraud in connection with fire; to preserve the public peace; to protect life and property; to prevent crime and to enforce state law concerning fires, combustion in any form, hazardous materials, explosives and potentially explosive devices, air quality standards, building regulations, and all statutes designed to prevent or otherwise regulate fire and the problems normally associated therewith. Section 2. That the following sections are hereby revised: Section 101.1. Insert: VERDIGRIS FIRE PROTECTION DISTRICT Section 3. That all other ordinances or parts of ordinances within the Verdigris Fire Protection District in conflict herewith are hereby repealed. Section 4. That if any section, subsection, sentence, clause or phrase of this legislation is, for any reason, held to be unconstitutional; such decision shall not affect the validity of the remaining portions of this ordinance. The duly elected board of directors of the Verdigris Fire Protection District hereby declares that it would have passed this law, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. Section 5. That nothing in this legislation or in the Fire Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 4 of this law; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this legislation. Section 6. That the Clerk is hereby ordered and directed to cause this legislation to be published, (An additional provision may be required to direct the number of times the legislation is to be published and to specify that it is to be in a newspaper in general circulation. Posting may also be required.) Section 7. Emergency Clause. An emergency is hereby declared to exist whereby it is necessary for the preservation of the public health, safety, and welfare of the inhabitants of the Verdigris Fire Protection District, that this Resolution shall be in full force and effect immediately from and after the date of its final passage and adoption.
