TOWN OF VERDIGRIS, OKLAHOMA ORDINANCE NO. 2018-03 AN ORDINANCE AMENDING SECTION 15-235 OF THE CODE OF ORDINANCES OF THE TOWN OF VERDIGRIS PROVIDING PARKING PROHIBITIONS IN SPECIFIC AREAS; PROVIDING A PARTIAL INVALIDITY SAVINGS CLAUSE; REPEALING CONFLICTING ORDINANCES; AND PROVIDING AN EMERGENCY CLAUSE. WHEREAS, the Town Board of Trustees of the Town of Verdigris, Oklahoma, deems it in the best interest of the Town and public health, welfare and safety to adopt an ordinance prohibiting parking on a front or back yard, lawn, or another ground adjoining a house or residential building other than on a driveway. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF VERDIGRIS, OKLAHOMA: Section 1: Section 15-235 of the Town of Verdigris Code of Ordinances is hereby amended to read as follows: SECTION 15-235 PARKING PROHIBITION IN SPECIFIC AREAS Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall: 1. Stop, stand or park a vehicle: a. On the roadway side of any vehicle stopped or parked at the edge or curb of a street except as authorized otherwise in this section; b. On a sidewalk; c. Within an intersection; d. On a crosswalk; e. Along or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic; f. On any railroad tracks; g. At any place where official signs prohibit stopping or parking; or h. On a front or back yard or lawn or other ground adjoining a house or residential building other than on a driveway. Section 2: Partial Invalidity Savings Clause. If any section, subsection or sentence, clause or phrase of this Ordinance is for any reason held invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance. Section 3: Repeal of Conflicting Ordinances. All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby expressly repealed. Section 4: The provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the Town of Verdigris. Section 5. EMERGENCY CLAUSE. An emergency is hereby deemed and declared to exist whereby it is necessary for the preservation of the public health, safety and welfare of the inhabitants of the Town of Verdigris, Oklahoma, that this ordinance shall be in full force and effect immediately from and after its passage, approval and adoption. ADOPTED and APPROVED by the Board of Trustees of the Town of Verdigris, Oklahoma, this 15th day of November, 2018, by a vote on Sections 1 through 4 first, then by a separate vote on Section 5 (Emergency Clause).
