FORECLOSURE NOTICE DEFAULT having been made in the payment of the indebtedness secured by that mortgage dated May 20, 2013, in favor of The HomeTown Bank of Alabama, a corporation, and executed by J. D. Smith and Jo Ann Smith, husband and wife, which mortgage is recorded June 5, 2013, in Mtg Book 1709, Page 106, in the probate records of Cullman County, Alabama, the mortgagee has elected to declare the entire indebtedness secured by said mortgage to be due and payable as provided in said mortgage, and notice is hereby given that pursuant to the law and power of sale contained in said mortgage, the undersigned will sell at public outcry to the highest bidder for cash at the front doors of the Cullman County Courthouse at Cullman, Alabama, at the legal hours of sale, on December 29, 2015, the following described real estate situated in Cullman County, Alabama, to-wit: Beginning at Southeast corner of Section 27, Township 9 South, Range 1 West; thence N 2°00' West a distance of 1329.00 feet to a point; thence South 87°50' W a distance of 739.7 feet to a point in center of paved road; thence S 2°00' E 46.00 feet to the East right of way of a county road and the true place of beginning of the property herein described; thence from said true place of beginning continue S 2°00' E 903.00 feet; thence N 72°00' W 593.94 feet to the East right of way, of a county road; thence along said right of way by the following bearings and distances: N 37°30'E 368.00 feet; thence N 40°52' E 221.5 feet; thence N 38°15 E 200.00 feet; thence N 29°23"E 110.95 feet to the point of beginning and containing 5.59 acres more or less. (w2j/34803parents) Said sale is being made for the purpose of applying the proceeds to the debt secured by the mortgage and the expenses of foreclosure. The auctioneer will give to the purchaser an Auctioneer’s deed subject to ad valorem taxes due October 1, 2015, and October 1, 2016, subject to any and all statutory rights of redemption, previous mortgages, if any, all easements, encroachments, unrecorded leases, if any, any rights of way for road, or otherwise, utilities, title to all minerals and all restrictions and covenants of record.
