MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain mortgage executed on September 23, 2011 by Robert Scott Runge, Husband and wife, and Jessica R. Runge, husband and wife, originally in favor of Mortgage Electronic Registration Systems, Inc. as nominee for EvaBank, and recorded in MTG Book 1658 at Page 967 on September 26, 2011, in the Office of the Judge of Probate of Cullman County, Alabama, and secured indebtedness having been transferred or assigned to JPMorgan Chase Bank, N.A. as reflected by instrument recorded in Misc Book 276, Page 848; Misc Book 309, Page 21 and Book 276, Page 848 of the same Office. Shapiro and Ingle, L.L.P., as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on January 21, 2016, sell at public outcry to the highest bidder in front of the main entrance of the Cullman County, Alabama, Courthouse in the City of Cullman, during the legal hours of sale, the following real estate situated in Cullman County, Alabama, to wit: Tract 1: A part of the south half of the NW 1/4 of the SE 1/4 of Section 31, Township 8 South, Range 2 West, more particularly described as beginning at the southwest corner of said twenty acre tract; thence N 4°00'45" W along the west line of said twenty acre tract 426.47 feet to the true point of beginning of the property herein described; thence from said true point of beginning continue N 4°00'45" W along said west line 244.52 feet to the northwest corner of said twenty acre tract; thence N 88*00' E along the north line of said twenty 161.18 feet to a point in the centerline of Holmes Road (County Road 1428); thence S 11°44'51" W along said centerline 172.63 feet ; thence S 9°04'39" W along said centerline 74.9 feet to a point; thence S 86°07'29" W 97.23 feet to the true point of beginning. ALSO: A 15 foot easement for a drive being 7.5 feet either side of the following described centerline: Beginning at the southeast corner of the above described property; thence S 86°07'29" W 21/73 feet to a point on the west right of way of Holmes Road (County Road 1428) and the true point of beginning of said centerline; thence from said true point of beginning S 78°42'43" W along the center of an existing gravel drive 76.11 feet. The above described property is also subject to the easement which crosses said property and is being used by the adjoining property owner for ingress-egress. Tract II: All that part of the south half of the NE 1/4 of the SW 1/4 of Section 31, Township & South, Range 2 West, more particularly described as: Beginning at the southeast corner of said forty; thence N 4°00'45" W 244.52 feet to the northeast corner of the south half of the NE 1/4 of the SW 1/4; thence S 88°07'29" E 64.82 feet to the true point of beginning. Subject to all rights of other persons and parties to the use of an easement for ingress and egress that crosses the subject property. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
