CJ-2015-76G (Published in the Friday editions of The Duncan Banner, January 8 and 15, 2016-2 times) NOTICE OF SHERIFF'S SALE District Court Case No. CJ-2015-76G Property Address: 401 Eastland Dr., Duncan OK 73533 Notice is hereby given that in pursuance of an execution and order of sale issued out of the District Court of Stephens County, Oklahoma, on the 17 day of December, 2015, in an action wherein Mortgage Clearing Corporation was Plaintiff and Steven Lemons; Cheryl Lemons; Occupants of the Premises, 401 Eastland Dr., Duncan, OK 73533; Jane Doe, spouse of Steven Lemons a/k/a Steven W. Lemons, if any; John Doe, spouse of Cheryl Lemons a/k/a Cheryl L. Lemons, if any were Defendants, directed to the Sheriff of Stephens County, Oklahoma, commanding that he levy upon and sell with appraisement the following described property in Stephens County, Oklahoma, to-wit: SURFACE AND SURFACE RIGHTS ONLY. A TRACT OF LAND BEGINNING 250.55 FEET SOUTH OF THE NE/CORNER OF SECTION 4, TOWNSHIP 1 SOUTH, RANGE 7 WEST, I.M., STEPHENS COUNTY, OKLAHOMA; THENCE WEST 176 FEET; THENCE SOUTH 76 FEET; THENCE EAST 176 FEET; THENCE NORTH 76 FEET TO THE POINT OF BEGINNING. to satisfy a judgment and decree of mortgage foreclosure in favor of said Plaintiff and against Steven Lemons a/k/a Steven W. Lemons, obtained and made in said Court on the 16 day of November, 2015, on its cause of action wherein the court found that there was due the amount of $52,627.96 principal, interest from the 1st day of January, 2015 at the rate of 5.000 per cent per annum, late charges in the amount of $201.68, escrow shortage of $719.72, abstracting and any other advancements made by Plaintiff for protection and preservation of the property in the amount of $3.407.00, attorney's fees in the amount of $2,500.00, all as of November 5, 2015, and the costs, all accrued and accruing herein, he will on the 10th day of February, 2016, at the hour of 10:00 A.M of said day at the Stephens County Courthouse, 101 S. 11th St., Duncan, Oklahoma 73533, offer for sale and sell to the highest bidder for cash, the said property above described, or as much thereof as will satisfy said judgment with interest, costs and attorneys' fees, said sale to be subject to taxes on said property, if any; the total appraised value of said property being the sum of $45,000.
