NOTICE OF FORECLOSURE Default having been made in the payment of the indebtedness secured by that certain mortgage dated June 5, 2009, executed by Dusty L. Latham and Leslie L. Latham, husband and wife, to JPMorgan Chase Bank, N.A., which mortgage was recorded on June 26, 2009, in Mortgage Book 1602, Page 351, of the mortgage records in the Office of the Judge of Probate of Cullman County, Alabama, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Cullman County Courthouse at Cullman, Alabama, during the legal hours of sale on August 4, 2015, the following described real estate, situated in Cullman County, Alabama, to-wit: Tract I: All that part of the Northeast quarter of Section 33, Township 8 South, Range 1 East of the Huntsville Meridian, Cullman County, Alabama, more particularly described as commencing at the center of the Northeast quarter of said Section 33; thence North 05 degrees 04 minutes West 655.31 feet; thence South 89 degrees 03 minutes 40 seconds West 662.86 feet to the Point of Beginning; thence from the Point of Beginning South 05 degrees 17 minutes 21 seconds East 372.51 feet to a point in the centerline of a cul-de-sac; thence along the centerline of a county road South 49 degrees 47 minutes 40 seconds West 294.22 feet; thence leaving said centerline North 11 degrees 56 minutes 20 seconds West 568.10 feet to a point in the centerline of a county road; thence along said centerline North 88 degrees 41 minutes 20 seconds East 304.23 feet to the Point of Beginning and containing 3.00 acres, more or less. Subject to a 30 foot right of way along the North boundary for a public road. Also, subject to a 30 foot right of way along the South boundary for a public road. Subject to easements, rights of way, or restrictions as of record. Tract II: An undivided 1/35th interest in and to the following described property, to wit: Beginning at a point which is located South 57 degrees 50 minutes East 1438.77 feet from the center of the Northwest 1/4 of Section 33, Township 8 South, Range 1 East, Cullman County, Alabama; thence from the Point of Beginning North 54 degrees 16 minutes East 210.0 feet to a point; thence South 20 degrees 44 minutes East 210.0 feet to a point; thence South 54 degrees 16 minutes West 210.0 feet to a point; thence North 20 degrees 44 minutes West 210.0 feet to the Point of Beginning and containing 1.0 acres, more or less.
