“LET THE BIBLE SPEAK” Many fail to appreciate the immense value of the Bible. The Bible contains God’s written revelation to mankind. The Bible is the book of all books. It tells of man’s origin; his purpose on the earth; and his eternal destiny. The Bible, unlike any other book is divinely inspired. Paul, the Apostle wrote to Timothy, “All Scripture is given by inspiration of God, and is profitable for doctrine, for reproof, for correction, for instruction in righteousness, that the man of God may be complete, thoroughly equipped for every good work,” 2 Tim. 3:16-17. Peter wrote, “Knowing this first, that no prophecy of Scripture is of any private interpretation, for prophecy never came by the will of man, but holy men of God spoke as they were moved by the Holy Spirit.”2 Pet 1:20-21. One such holy man, was the prophet Jeremiah who wrote, “But his word was in mine heart as a burning fire shut up in my bones, and I was weary with forbearing, and I could not stay,” Jer. 20:9. The prophet Isaiah provides us with this account of his com mission : “Then flew one of the seraphim unto me, having a live coal in his hand, which he had taken with the tongs from off the altar: and he touched my mouth with it, and said, Lo, this hath touched thy lips; and thine iniquity is taken away, and thy sin forgiven. And I heard the voice of the Lord, saying, Whom shall I send, and who will go for us? Then I said, Here am I; send me,” Isa. 6:6-8. Jesus stressed the authority and inspiration of the scriptures. Following his resurrection he told his disciples, “These are the words which I spoke to you while I was still with you, that all things must be fulfilled which were written in the Law of Moses and the Prophets and the Psalms concerning Me.” And He opened their understanding, that they might comprehend the Scriptures,” Lk 22:44-45. On another occasion Jesus said, “You search the Scriptures, for in them you think you have eternal life; and these are they which testify of Me,” John 5:39-40. We are greatly blessed to have the written revelation of God in the Bible. The Litigation is called Dorsey J. Reirdon v. Cimarex Energy Co., Case No. 6:16-CV-00113-KEW. The Litigation is pending in the United States District Court for the Eastern District of Oklahoma before Magistrate Judge Kimberly E. West. This notice is a summary only. On September 28, 2018, the Court preliminarily approved a Settlement in the above-captioned litigation (the “Litigation”) between Plaintiff Dorsey J. Reirdon (“Plaintiff”), on behalf of himself and the Settlement Class, and Cimarex Energy Co. (“Defendant”). In settlement of all Settlement Class claims asserted in the Litigation, Defendant has agreed to (1) pay $9,500,000.00 in cash (“Gross Settlement Fund”), which will be distributed in accordance with the Settlement Agreement and orders of the Court, and (2) provide other relief described in the Settlement Agreement. What Is the Litigation About? The Litigation seeks damages for Defendant’s alleged failure to pay statutory interest on payments made outside the time periods set forth in the Production Revenue Standards Act, 52 Okla. St. §570.1, et seq. (the “PRSA”) for oil and gas production proceeds from oil and gas wells in Oklahoma. The Court did not decide which side was right. Defendant denies that certification would be proper in a contested class action and denies any and all allegations of wrongdoing and liability. Defendant has only agreed to the proposed Settlement to avoid the uncertainty, burden, and expense of continued litigation. Likewise, Plaintiff has agreed to the proposed Settlement to avoid the uncertainty, burden, and expense of continued litigation. Who Are Class Members? The Settlement Class includes: All non-excluded persons or entities who, between March 15, 2011 and July 31, 2018 received payments from Cimarex (or Cimarex’s designee) for oil and gas production proceeds from Oklahoma oil and gas wells. The persons or entities excluded from the class are: (1) agencies, departments, or instrumentalities of the United States of America or the State of Oklahoma; (2) publicly traded oil and gas companies and their affiliates; (3) persons or entities that Plaintiff’s counsel may be prohibited from representing under Rule 1.7 of the Oklahoma Rules of Professional Conduct, including, but not limited to, Charles David Nutley, Danny George, Dan McClure, Kelly McClure Callant, and their relatives and any related trusts; and (4) officers of the court. Please visit the website listed at the bottom of this document for more detailed information concerning the proposed settlement. What Does the Settlement Provide? In consideration of the Settlement, Defendant has agreed to pay $9,500,000.00 that will be distributed according to the terms of the Settlement Agreement, the documents referenced in and exhibits to the Settlement Agreement, and orders from the Court. In addition, Defendant has agreed, commencing within the later of (i) 6 months after execution of the Settlement Agreement or (ii) 30 days after the date a judgment approving the Settlement becomes Final and Non-Appealable, to implement new procedures and policies for paying statutory interest to royalty interest owners and overriding royalty interest owners in Oklahoma without awaiting a demand for such statutory interest, and will maintain such procedures unless or until there is a change in the law. See the Settlement Agreement for full details. Plaintiff estimates these Future Benefits have an estimated net present value of at least $11,000,000.00 to the Settlement Class. The Court will deduct Plaintiff’s Attorneys’ Fees, Litigation Expenses, Plaintiff’s Case Contribution Award, the amount of money attributable to Class Members who are excluded from the Settlement Class, and other fees and expenses from the Gross Settlement Fund, and the remainder of the fund (the “Net Settlement Fund”) will be distributed to eligible Class Members based on a variety of factors. These factors determining the amount distributed to each Class Member (if any) include the production date, the date the underlying payment was made, the amount of the underlying payment made, the time periods set forth in the PRSA, any additional statutory interest that Plaintiff’s Counsel believes has since accrued, and the amount of interest or returns that have accrued on the Class Member’s proportionate share of the Net Settlement Fund (if any) during the time such share was held in the Escrow Account. ALETHA McCASLAND SNOWDEN, DECEASED YOU ARE NOTIFIED that on the 9th day of October, 2018, the Petitioner, James Byron Stone, 5000 Lodge View, Austin, TX 78731, filed in the District Court of Stephens County, Oklahoma, a Petition for Summary Administration, Appointment of Special Administrator and Admission of Foreign Will to Probate. The Petitioner has alleged that Aletha M. Snowden, age 80, died on the 14th day of July, 2011, domiciled in Austin, Travis County, Texas, owning undivided mineral interests in Stephens and Grady Counties, both in Oklahoma. The total value of the decedent's property in Oklahoma is $16,667.00. Attached to the Petition as "Exhibit A" is a duly certified copy of the Application to Probate Copy of Lost Will and for Issuance of Letters Testamentary, Last Will and Testament, Order Probating Copy of Will and Authorizing Letters Testamentary and Letters Testamentary, said Will having been admitted to Probate Court No.1, Travis County, Texas, in Cause No. C-1-PB-15- 000792. The Petitioner has asked that this Court admit the Will to probate in the State of Oklahoma and order summary proceedings pursuant to OK ST T. 58 §245, et seq.
